Mivaldi Platform Terms of Service
1. Introduction & Beta Phase
Welcome to Mivaldi.com. The platform is currently operating in a testing phase (Beta Version), designed specifically for fashion models to build and manage their digital portfolios. By using the platform, you agree that the services are provided on an "AS IS" and "AS AVAILABLE" basis, without any express or implied warranties regarding continuous availability or absence of technical errors.
2. Technical Disclaimer & Data Backup
The user acknowledges and agrees that they are strictly and solely responsible for maintaining external backups of all images, videos, texts, and data uploaded to the platform. These backups must be kept entirely outside of Mivaldi’s servers. The platform administration categorically disclaims any legal or technical liability for any loss, corruption, or leakage of data. The user holds no right to claim any compensation in the event of temporary or permanent service downtime or content loss.
3. Intellectual Property & Content Liability
The user (the fashion model) bears full, personal, and absolute legal responsibility for all materials uploaded to the platform.
- The user must own the copyright or possess the necessary licenses to publish the uploaded images and content.
- Mivaldi explicitly disclaims any liability for any third-party intellectual property infringement committed by the user.
- The platform reserves the absolute right to delete any content or suspend/terminate any account immediately, without prior notice or justification, if the content is deemed to violate these terms, break the law, or harm the platform's reputation.
4. Payments & Refund Policy
Due to the nature of the Beta phase, payments are currently processed manually (Cash or Bank Transfer).
- Voluntary Cancellation: If a user voluntarily cancels their subscription, they are not entitled to a refund for the months during which the platform was successfully utilized. Refunds will only be issued for the remaining (unused) months of the subscription period.
- Refund Processing: Approved refunds will be processed within a maximum period of 15 business days from the date of the cancellation request approval.
- Transfer Fees: Any applicable bank fees or transfer commissions incurred during the refund process will be entirely deducted from the final refunded amount.
5. Termination for Violations
If a user violates any of these Terms of Service (including, but not limited to, uploading stolen content, inappropriate material, or infringing on third-party rights), their account and services will be terminated immediately. In such cases of termination for breach, the remaining balance of the subscription fee will be permanently forfeited and confiscated by Mivaldi as compensation for administrative, technical damages, and effort.
